1. In general
a. These conditions apply to every agreement between Talk Dutch 2 and the client and to every course of action between Talk Dutch 2 and the student.
b. Talk Dutch 2: a language training agency specializing in Dutch as a second language, represented by E.J. Bergsma. Registered with the Chamber of Commerce under number 73721166.
c. Client: a person who orders Talk Dutch 2 as a course participant or on behalf of his/her company to provide advice, tailor-made language training, or a workshop.
d. Course participant: a person who attends the training course or workshop, or receives advice. The course participant can be the same person as the customer.
e. If a situation should occur between parties that has not been regulated in these general terms and conditions, this situation should be judged according to the spirit of these general terms and conditions.
2. Agreement
a. The prices mentioned in the offer are inclusive of VAT. Other costs such as study books are not included in the offer.
b. In the event of long-term absence due to force majeure (such as illness, or death), the program will be postponed in consultation.
3. Payment
a. Talk Dutch 2 will send invoices to the client by email.
b. Client: the quoted amount must be paid in full at the start of the language course unless agreed otherwise in the quotation.
c. Client: the number of lessons agreed in the offer will always be charged, even if the course participant decides to stop the lessons halfway through. Unless there is a case of force majeure (see under 2.b).
d. Payment must take place within 10 working days after the invoice date.
e. In the event of cancellation of the agreement by the customer, all costs incurred, with a minimum of 25% of the total offer, will be charged.
4. Trajectory
a. The course participant is always partly responsible for the continuity of the course; he/she must comply with the homework agreements made and show up at the agreed time.
b. Talk Dutch 2 bears no responsibility for the final result of the lessons or for any consequences for the student of this result.
c. Missed lesson appointments will only be compensated when notice of an absence is given at least 24 hours in advance.
d. Missed lesson time due to a delay etc. will not be settled or compensated.
e. Personal details of the course member will never be provided to third parties by Talk Dutch 2.
f. Talk Dutch 2 reserves the right to suspend or terminate services without observing any notice period, in the case of client payment arrears of more than six weeks.
5. Termination
a. The language training agreement is entered into for a definite period of time. Notice of termination of the agreement must be given in writing.
b. The notice period is one calendar month.
c. Talk Dutch 2 is at all times authorized to cancel the agreement without observing a notice period, immediately, in the event that the client does not comply with his obligations under the agreement or the general conditions.
